TERMS OF SERVICE Last Updated: May 22, 2026 IMPORTANT NOTICE: THESE TERMS OF SERVICE CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN SECTION 12. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS AND AGREES TO RESOLVE ALL DISPUTES VIA BINDING INDIVIDUAL ARBITRATION. PLEASE READ IT CAREFULLY. 1. ACCEPTANCE OF THE TERMS OF SERVICE 1.1. Binding Agreement. These Terms of Service (the "Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Glass Gallery ("Company", "Platform", "we", "us", or "our"). By accessing, browsing, registering for, uploading content to, hotlinking, embedding, using our developer APIs, or otherwise interacting with the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Content Guidelines. 1.2. Authority. If you use our Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have full legal authority to bind such entity to these Terms, in which case "you" and "your" will refer to that entity. 1.3. Modifications. We reserve the right, at our sole discretion, to modify, amend, update, or replace these Terms at any time. Material changes will be notified via a prominent banner on our website or direct communication. Your continued use of the Platform after changes are posted constitutes unconditional acceptance of the revised Terms. 2. WHO CAN USE GLASS GALLERY (ELIGIBILITY) 2.1. Age Requirements. You may use Glass Gallery if you are over the minimum age of consent in your country. Our services are strictly prohibited for children under the age of 13. 2.2. Parental Supervision. If you are 13 to 18 years of age, you represent and warrant that you possess the explicit legal consent of a parent or guardian to use this Service under their supervision. Please ensure your parent or legal guardian has reviewed and discussed these Terms with you. 2.3. Account Restrictions. If we have previously disabled your account for violating these Terms or our guidelines, or for legal reasons, you are strictly prohibited from creating a new Glass Gallery account without our express written permission. 3. OUR LICENSE TO YOU 3.1. Limited Grant. Subject to your compliance with these Terms and our policies, we hereby grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access, view, explore, and use the Glass Gallery Service as contemplated under these Terms. 3.2. Prohibitions. Except as explicitly permitted by these Terms or our public APIs, you agree not to: (a) Modify, reverse engineer, or make derivative works based upon the Service. (b) Copy, scrape, harvest, index, or distribute any features, layouts, or visual assets of the Service. (c) Permitting unauthorized third parties to use or exploit your account credentials or platform access. 4. USER-GENERATED CONTENT, LICENSING, AND AUTOMATED PROCESSING 4.1. Ownership. You retain all copyright and intellectual property rights in the images, photos, comments, descriptions, metadata, and other content you upload to the Platform ("User Content"). 4.2. Operating License to Glass Gallery. By uploading, posting, or submitting User Content to the Platform, you grant Glass Gallery and our affiliates, successors, service providers, and partners a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable, and transferable license to host, store, cache, reproduce, modify, adapt, publish, distribute, publicly display, run, translate, and create derivative works of your content for the purpose of operating, distributing, advertising, optimizing, and promoting the Platform across all media formats. 4.3. Public Licensing Options. When uploading images, you may select and apply a public license (e.g., Creative Commons CC0, CC-BY, CC-BY-SA, CC-BY-NC). By selecting such a license, you acknowledge and agree that: (a) The public license represents a binding grant from you directly to the general public under the terms of that specific license. (b) This grant is irrevocable once the image is published on the Platform. (c) You are solely responsible for ensuring you possess all necessary rights to grant such public licenses. 4.4. Automated AI Safety Scanning and Concept Tagging. By uploading content, you acknowledge and explicitly consent to the following automated processing: (a) All uploaded images, titles, and descriptions are subject to automatic safety scanning by our automated AI engines to detect prohibited content (including CSAM, gore, violence, and hate speech). (b) Our automated systems will perform AI concept extraction (using models like Mistral, Gemini, or JigsawStack) to generate keywords, semantic concept descriptions, and tags. (c) These AI-generated concepts will be stored in our database, linked to your content, and utilized for feed personalization, smart suggestions, and search indexing. 4.5. Representations and Warranties. You represent and warrant that you own or have obtained all necessary third-party clearances, consents, releases, and intellectual property rights to upload the User Content, and that our use, hotlinking, or embedding of such content will not infringe the rights of any third party. 5. COMMERCIAL USE OF GLASS GALLERY If you want to use the Glass Gallery Service for commercial purposes (including but not limited to corporate portfolio showcases, business advertising, commercial image hotlinking, or monetized API-based integrations), you must comply with these Terms and agree to defend, indemnify, and hold harmless Glass Gallery and its officers, directors, and employees from any losses, costs, or claims resulting from your commercial integration. 6. EMBEDDING, HOTLINKING, AND PUBLIC DEVELOPER APIs 6.1. Hotlink and Embed Permission. Glass Gallery offers an image rendering and embedding feature (e.g., via the API endpoint `action=render`). By uploading images to the Platform, you acknowledge and agree that other users and external third-party websites may dynamically hotlink, render, or embed your public images onto their own websites, platforms, or applications using our embed codes or public endpoints. 6.2. Developer API Terms. If you utilize our public Developer APIs to fetch, display, query, or integrate Glass Gallery images, you agree: (a) To respect all rate limits, API key restrictions, and system constraints. (b) To display proper attribution to the original creator and provide a direct hyperlink back to the corresponding Glass Gallery image detail page. (c) To not use our API for illegal, scraping, or mass-harvesting purposes without express written consent. 6.3. Third-Party Embeds Disclaimer. Glass Gallery acts as a technical intermediary. We do not control, monitor, or accept any liability for how, where, or by whom our embed codes or API image streams are used on external third-party websites. You agree to hold Glass Gallery harmless from any disputes arising from external third-party embeds of your public images. 7. PROHIBITED USES AND AUTOMATED SCRAPING BANS You agree not to use the Platform to: 7.1. Violate laws, regulations, or third-party intellectual property or privacy rights. 7.2. Upload, host, or transmit child sexual abuse material (CSAM) or any content that exploits minors. 7.3. Share unauthorized mature, pornographic, violent, hateful, or harassing content. 7.4. Interfere with, disrupt, or hack the Platform's servers, databases, or API infrastructure. 7.5. Scraping and Crawling Restriction. You agree not to scrape, collect, search, copy, download, or otherwise access data or content from Glass Gallery in unauthorized ways, such as by using automated crawling scripts, bots, spiders, scrapers, or automated means (without our express prior written permission), or access or attempt to access data you do not have permission to access. 7.6. Hotlink images using excessively high bandwidth that threatens the technical stability of our Cloudflare and Turso Edge infrastructure. 8. COPYRIGHT INFRINGEMENT AND DMCA SAFE HARBOR 8.1. DMCA Compliance. We respect intellectual property rights and operate in accordance with the Digital Millennium Copyright Act ("DMCA") safe harbor provisions (17 U.S.C. ยง 512). If you believe that your copyrighted work has been copied and posted on our Platform in a way that constitutes copyright infringement, please submit a written DMCA Notice to our designated agent: Email: dmca@modvc.org 8.2. DMCA Notice Requirements. Your written DMCA Notice must include: (a) A physical or electronic signature of the copyright owner or authorized representative. (b) Description of the copyrighted work claimed to have been infringed. (c) Precise URL links or image IDs to locate the infringing material on our Platform. (d) Your contact details (name, address, telephone number, and email). (e) A statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. (f) A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. 9. DISCLAIMER OF WARRANTIES THE PLATFORM, INCLUDING ALL USER CONTENT, IMAGES, METADATA, APIs, AND DEVELOPER SERVICES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, GLASS GALLERY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, SYSTEM SECURITY, ACCURACY, AND NON-INFRINGEMENT. We do not guarantee that the Platform will be uninterrupted, error-free, completely secure, or free from viruses or other malicious components. 10. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GLASS GALLERY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLATFORM, THIRD-PARTY EMBEDS, OR DEVELOPER APIs, EVEN IF ADVISE OF THE POSSIBILITY OF SUCH DAMAGES. Our cumulative total liability shall not exceed the amount paid by you, if any, to us in the preceding twelve (12) months. 11. INDEMNIFICATION You agree to defend, indemnify, and hold harmless Glass Gallery, its parent companies, affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your violation of these Terms, or your misuse of our developer APIs or embed features. 12. GOVERNING LAW AND BINDING ARBITRATION 12.1. Delaware Law. All disputes or claims arising out of or relating to these Terms, the Platform, or its operations shall be governed by, and construed in accordance with, the laws of the State of Delaware, United States, without regard to choice of law or conflict of law principles. 12.2. Binding Arbitration. Any dispute, controversy, or claim arising out of or relating to this agreement, including its formation or breach, shall be settled by binding arbitration administered by JAMS or the American Arbitration Association (AAA) in Wilmington, Delaware, before a single neutral arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. 12.3. Class Action Waiver. YOU AND GLASS GALLERY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR GLASS GALLERY WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, CITIZEN GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.
